Terms and Conditions

1 - DEFINITIONS

Throughout these General Terms and Conditions, the following definitions apply. The singular includes the plural, and the plural, the singular.

« Buyer »: a User, being a private individual, interested in the purchase of an Item through the Website. The purchase of Items for professional purposes is strictly prohibited.

« Contract »: contract for sale of an Item between the Buyer and Seller.

« Description »: the whole of the information set out in the description by the Seller in relation to the Item (size, colour etc).

« Head Office »: Head office located at Quai Orban 48/71 at 4020 Liège, Belgium.

« Item »: Cards and fine stationery proposed for sale on the Website. The Items consist of protected printed cards designed by the Seller. The Items are new and sold after customization done by the Buyer in the condition shown on the Website.

« Password »: the password, composed of a minimum of three (3) characters (either letters or numbers), chosen by the User and used in order to access the Services.

« Price »: the sale price of an Item as set out on the Website. The Price includes VAT but excludes the delivery costs.

« Seller »: the Belgian company « CMU SPRL », whose registered office is at Quai Orban, 48/71 at 4020 Liège, Belgium, company number 0840.392.261 and intra-community VAT number BE 0840.392.261.

« Services »: the whole of the services proposed on the Website.

« User »: any person able to enter into a contract and register themselves on the Website and use the Services.

« User information »: all personal information communicated by the Buyer in relation to the use of the Services.

« Website »: online shop through the web address www.cardsoo.co.uk.

2 - GENERAL

These General Terms and Conditions are a translation of the French version and for reference only. Original version can be found through www.fairepartoo.fr/page/termes-et-conditions. Please read these General Terms and Conditions carefully. These set out the contractual rights for the access to the Website and the Services offered by the Seller.

In order to be able to buy on the Website, Users can eventually register their details. During the registration procedure, you will be asked to accept the General Terms and Conditions. Once accepted you will be deemed to have taken knowledge of them.

It is advisable that you print the General Terms and Conditions before registering as a User or as a Buyer.

You will be asked to confirm that you accept these General Terms and Conditions before any purchase on the Website.

3 - PURPOSE OF THE TERMS AND CONDITIONS

These General Terms and Conditions define the rights and obligations of the Parties in relation to the Sale of Items on the Website. Only private individuals can purchase on the Website.

The Seller reserves the right to adapt or modify the General Terms and Conditions at any time as a result in a change of law or otherwise.

That version of the Terms and Condition in French (www.fairepartoo.fr/page/termes-et-conditions) takes precedence over all other versions of foreign languages or translated.

4 - REGISTRATION AS A BUYER

In order to complete a purchase on the Website, the User can register and, after entering his User Information, choose an email and Password. The User will then save time on the subsequent order and will have the full advantage of the Services offered on the Website.

It is forbidden for a Buyer to use an email or Password which does not belong to them. The Buyer shall take the necessary precautions in order to keep the Password confidential. The Buyer shall inform the Seller as soon as there is any fraudulent use of their Password.

The Seller reserves the right to refuse any registration of a Buyer where their intentions are suspicious, or do not conform with the General Terms and Conditions.

Once the registration process has been validated and confirmed by the Seller, the Seller shall grant access to the Services in accordance with the General Terms and Conditions.

In relation to the use of the Services, the User shall ensure that the User Information is correct and precise. The Seller reserves the right to put an end to the Services if the Website is used in a fraudulent way.

5 - ACCESS TO THE WEBSITE

The Users are normally allowed to use the Website 7 days a week and 24 hours a day. The Seller cannot be held responsible for any technical problems, including any maintenance required for the Website or any other problems which may make the Website not accessible.

In case of an interruption in the Website or Service, the Seller will do its best to try and restore the Website or Services as soon as possible.

6 - DESCRIPTION OF THE ITEMS

The Seller shall do its best to photograph and describe the Items as best as possible.

The photographs are representations of the Items only and although these are taken with extreme care, there may be differences between the photograph and the Item. The Seller cannot be held responsible for any loss as a result in the Buyer relying on the photograph.

The color pictures of products in our Website may vary depending on the type of printing paper or computer screen or make different kinds as is and can not give an excuse to return, cancellation or refunds that are not stipulated in Article 11 of these Terms and Conditions.

All images on this site are protected by copyright and may not be reproduced without prior written consent of Seller.

7 - AVAILABILITY OF THE ITEMS

The Items are not unique and can be substituted for another.

Each Item remains available and for sale until the Price has been paid by the Buyer.

In the event of an Item not being available, which has been subject to a confirmed and paid order, the Buyer shall be informed by email or by telephone of the total or partial cancellation of the order. The Seller will then make a reimbursement.

8 - DETERMINATION OF THE PRICE

The Seller fixes the Prices. They are indicated in Euros and include VAT. The Prices do not include any delivery costs.

VAT applies to all sales in Belgium, except upon presentation of original records sealed applicable statutory minimum amounts, where an exemption from VAT.

For Europe, the Belgian VAT is currently 21% and will be applied to all not subject to VAT.

For Europe, the VAT payers will be exempted from VAT by us after verification of the validity of their VAT number to the appropriate agency, and provided that the good is actually delivered in their country from our stock following the provisions of legislation approved by the Belgian Federal Ministry of Finance.

If the VAT rate should be changed, this rate difference may be reflected in the price of items.

The Seller may modify the Prices indicated on the Website at any moment, either upwards or downwards. The Seller shall apply the Prices indicated at the time of the order.

9 - COMPLETION OF AN ORDER

In accordance with article 8 of the law of the 11 March 2003, the Sale is subject to the following:

The Buyer must follow the instructions which are given to him prior to making the purchase and confirming payment. The Buyer will have the chance to review and make any amendments to details given before confirmation of the order.

Once the order has been confirmed by the Buyer, he will receive, by email, a confirmation of the order from the Website including a summary of the order.

The order and receipt are deemed received once the parties to which these are addressed can access them.

Once the Sale is complete, the Contract will be archived by the Seller.

The Items remain the property of the Seller until the payment of the total Price (including any delivery costs) by the Buyer. All risks in relation to the Items will be transferred to the Buyer once the delivery company takes possession of the Items.

In the event of default of payment by the Buyer, the Seller will not be required to proceed with the delivery of the Items ordered by the Buyer.

The Seller reserves the right to refuse delivery or to complete an order for a Buyer who has not paid a previous order or where there is outstanding litigation.

10 - PAYMENT METHODS

The Sale is completed by payment of the Price by the Buyer.

Seller may use two providers of payment: MultiSafePay (www.multisafepay.com) and Paypal (www.paypal.com).

MultiSafePay and Paypal are suppliers of electronic payment services. MultiSafePay and Paypal put to the disposal of the Users a tool which controls the order information and payment, transmits the payment instructions to the bank and confirms the payment to the Buyer.

MultiSafePay and Paypal offer multiple payment options. MultiSafePay and Paypal respect the highest levels of security and confidentiality in relation to the details entered relating to the electronic payments.

All the information exchanged in order to make the payment are encrypted through the SSL (Secure Socket Layer) protocols. These details cannot be detected, intercepted or used by third parties. They are also not stored on the MultiSafePay and Paypal IT systems. MultiSafePay and Paypal are only a technical payment intermediary and do not take any responsibility in the follow up of the orders or any disputes in relation to these.

11 - RIGHT OF RETRACTION

The Buyer does not have the right of retraction for Items proposed by the Seller and personalised by the Buyer.

12 - EXCHANGE

If the Buyer receives a defective or wrong Item, he must notify us in writing to the Head Office within 14 days of delivery.

Defective or wrong Item must be directed to the Head Office and transportation costs will be borne by the Seller.

After examination of the goods, if indeed our fault, and according to our possibilities, either we replace the Items at our expense or we will refund the Buyer.

After this period of 14 days, no exchanges or refunds will be allowed.

If the Buyer was mistaken in his Item and he wants a trade, it will send the Item entirely at his expense.

Items should be returned in its original packaging "NOT OPEN AND WILL REMAIN SEALED ORIGINAL" and can not be unpacked from its original packaging to delivery.

If the Seller finds the return of the Item that it was:

- Open,
- Unsealed,
- Used
- Covered with traces of use,
- Victim of odor,
- Victim of manipulation,
- Victim of fraud to conceal the items mentioned above,

This exchange right to cancel the order without the Buyer is entitled to any compensation on this Item and shall remain available at the Head Office or returned to the charge and the charge previously paid by the Buyer.

After checking back as explained above, an invoice payable in advance by the Purchaser will be addressed and it will contain fixes prices (change in model, color, size, etc.) ; necessary to achieve the new Item.

If the Item purchased by the Buyer on our Site on behalf of a third person is not suitable for those who receive the Item may be some reasons for this to be changed, exchanged or refunded for any reason it would not be that stated in these terms.

13 - RIGHTS AND OBLIGATIONS OF THE SELLER

The Seller shall not propose any Items for sale which it knows are counterfeited or have been obtained illegally. The Seller shall ensure that the information in relation to the nature and quality of the Item is correct.

The Seller is committed to an obligation of means, executing the implementation of Item the best he can.

The Seller retains the property of the Items until the Price has been paid in full by the Buyer.

14 - DELIVERY METHODS

The Item purchased will be delivered at the delivery address communicated by the Buyer during the ordering process. The Items cannot be delivered to a postal box.

The Item is delivered to the Buyer, or any other person present at the delivery address. If nobody is available to receive the Item, a note will be left by the delivery company stating how the Item should be retrieved by the Buyer.

The Seller will try to ensure that the order is processed and delivered as quickly as possible relating the place of delivery.

The delivery delay set out in the order confirmation is only indicative. Thee Buyer shall not be held responsible for any eventual delay in the processing of the orders or deliveries.

Shipping fees are offered to Buyer for any order of the Item to be sent to the European Union and Switzerland.

The additional shipping charges are paid by the Buyer.

Unless proved to the contrary, proof of delivery issued by the delivery company shall form a presumption of effective delivery of the order and receipt by the Buyer.

In the event of the Buyer proving non delivery within thirty (30) business days after the order confirmation, it is possible for the Buyer to cancel the order. Notification should be given by email to info@cardsoo.co.uk with read receipt.

The amount debited from the account of the Buyer will be reimbursed by the Seller as soon as possible.

The refund of the order will be done as soon as possible following receipt of the Items by the Seller and as long as all the return conditions have been met. The amount reimbursed will be, in any case, limited to the amount paid by the Buyer.

15 - INTELLECTUAL PROPERTY

All intellectual rights relating to the Website are the property of the Seller.

The User shall not use or exploit in any other way any or all of the elements which create the Website, including but not limited to any texts, cards, fields, names, logos, graphics or any other material on the Website.

The entire Website falls within the Belgian legislation, European and International copyright and intellectual property laws.

All rights reserved, including the iconographic and photographic documents.

16 - PROHITBITION OR LIMITATION OF ACCESS

The Seller reserves the right to limit or prohibit access to the Services to any User who does not respect the General Terms and Conditions.

17 - USER NOTIFICATIONS

All messages or notifications sent to a User in relation to the use of the Services will be done by email to the address registered by the User during the registration process or contained in the Sellers’ database.

The Seller cannot be held responsible for any prejudice linked to the non-functionability or failure to update an email address.

18 - USE OF INFORMATION

The Seller is responsible for managing the User Information. The User Information given to the Seller can be used by the Seller for direct marketing purpose initiated by the Seller. The User can oppose to the use of the User Information for direct marketing by notifying the Seller at the address below.

In accordance with the Belgian law of 8 December 1992 relating to the use of information in relation to personal information, the User has a right of access, rectification and opposition of the information relating to him. Any request for information in relation to this must be done by writing at the following address :

19 - LITIGATION AND MEDIATION

These General Terms and Conditions are governed by Belgian law.

The parties will be use their best endeavours to settle any dispute in relation to these General Terms and Conditions by mutual understanding.

If a mutual understanding is not agreed, then the Parties shall follow a voluntary civil mediation procedure. The parties will choose a mediator by mutual consent.

In the event of the impossibility for a mediator to intervene, litigation will be carried out in the Liège tribunals. The language and procedure will be carried out in French.
